(Seattle, WA) – Today in King County Superior Court, Judge John Ruhl heard oral arguments in Kunath v. City of Seattle. Judge Ruhl considered the parties’ oral arguments alongside the written briefs submitted in support of motions for summary judgment in the case. Summary judgment means the Court may render a decision without conducting a trial. Judge Ruhl indicated he will make a ruling before Thanksgiving.
Matt McIlwain, founder of the Opportunity for All Coalition which is supporting the legal challenge to the income tax, released the following statement after the hearing.
“Since day one, we have said that the Seattle income tax is illegal, unnecessary, and unwanted. The Opportunity for All Coalition believes there is a better way forward that encourages economic growth while keeping the city attractive for job creators and residents alike.
We are confident the Court will rule in our favor, but expect the illegal tax’s advocates to appeal to the Supreme Court. Sadly, this continues a process that has wasted taxpayer dollars while attempting to reverse nearly 85 years of Supreme Court rulings that, under Washington’s state constitution, income is property and must be taxed uniformly.
“This will be an important victory, but the fight is not over. We must continue to highlight why the City’s income tax approach is illegal and wrong, and that its supporters’ ultimate goal is a statewide income tax – even though similar proposals have been rejected by Washingtonians ten times already.”
The Opportunity for All Coalition is a non-profit 501(c)4 organization whose mission is to support a legal challenge to the recently passed Seattle income tax.
